If you wish to file for divorce in Indiana, either you or your spouse must have resided here for six months or more. Individual counties also have a three-month waiting period. If you have lived in the same place for at least the past six months, you satisfy both requirements.
How does Indiana’s waiting period for divorce work?
Once a divorce petition is filed, Indiana law requires a waiting period of 60 days before it can be finalized, even when there are no disagreements about the terms. This period allows for the possibility of reconciliation and ensures that both parties have time to fully consider their decision.
